Terms of Service

v1.01. Introduction
Welcome to TrackBounty. These Terms of Service ("Terms") govern your access to and use of the TrackBounty website, platform, Discord bot, and all related services (collectively, the "Service"). The Service is operated by TrackBounty, based in the United Kingdom.
By creating an account or using the Service in any way, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, do not use the Service.
If you use the Service as a Creator, the Creator Agreement also applies. If you use the Service as a Label, Artist, Agency, or Manager ("Client"), the Client Agreement also applies.
2. Definitions
- "Platform" means the TrackBounty website, web application, API, and Discord bot.
- "Creator" means a user who registers to promote music or content via TikTok campaigns.
- "Client" means a record label, independent artist, agency, or manager who creates and manages campaigns.
- "Campaign" means a promotional opportunity created by a Client, offering payment to Creators for TikTok content.
- "Submission" means a TikTok video submitted by a Creator to a Campaign.
- "Tenant" means a Client's workspace on the platform, containing their campaigns, creator roster, and settings.
3. Eligibility
You must be at least 13 years old to use TrackBounty. If you are under 18, you must have the permission of a parent or legal guardian. To receive payments through the platform, you must be at least 18 years old or have a parent or guardian manage payment on your behalf.
By using the Service, you represent that you have the legal capacity to enter into these Terms and that you are not prohibited from using the Service under any applicable law.
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Providing accurate, current information during registration and keeping it updated.
- Notifying us promptly if you suspect unauthorised access to your account.
You may not create multiple accounts, share account credentials with others, or transfer your account without our written consent. You may not impersonate another person or entity.
5. Platform Role & Payments
TrackBounty is a marketplace and payment processor. We provide the technology platform that connects Clients with Creators, tracks campaign performance, and processes payments between the parties.
Payment Processing
TrackBounty uses Stripe, an FCA-authorised payment institution, as its payment processor. Funds are held by Stripe on behalf of users — TrackBounty does not hold user funds directly.
Platform Fees
TrackBounty charges a platform fee of 10% from both sides:
- Client fee: 10% is added on top of the campaign budget at the time of funding.
- Creator fee: 10% is deducted from Creator earnings before crediting their wallet balance.
Fee rates are configurable per-tenant. Some workspaces may operate with different fee structures or manual off-platform payment arrangements at TrackBounty's discretion.
Limitations
TrackBounty is not a bank, e-money institution, or financial adviser. Wallet balances are non-interest-bearing and represent a right to request withdrawal, not a deposit. We do not endorse, verify the accuracy of, or guarantee any user-generated content, campaign descriptions, or claimed results. We reserve the right to moderate content and remove material that violates these Terms.
6. Prohibited Conduct
All users agree not to:
- Engage in fraud, including fake views, fake accounts, bot engagement, view-buying, or manipulation of engagement metrics.
- Circumvent platform security, verification, or fraud detection systems.
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Harass, abuse, threaten, or discriminate against other users.
- Scrape, crawl, or use automated tools to extract data from the platform.
- Reverse-engineer, decompile, or disassemble any part of the Service.
- Interfere with the proper operation of the Service or impose an unreasonable load on our infrastructure.
- Use the platform to recruit users for off-platform transactions to circumvent TrackBounty.
Violation of these rules may result in immediate account suspension or permanent ban. See our Acceptable Use Policy for full details.
7. Intellectual Property
The TrackBounty name, logo, design, and branding are the property of TrackBounty. You may not use our trademarks, logos, or branding without prior written permission.
User-generated content (TikTok videos, campaign descriptions, profile information) remains the property of the user who created it. By uploading content to TrackBounty, you grant us a limited, non-exclusive licence to display and process that content for the purpose of operating the Service.
8. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, TrackBounty shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or business opportunities.
- Losses arising from the actions, omissions, or content of other users.
- Losses arising from reliance on TikTok or third-party API data.
- Service interruptions, errors, or security breaches beyond our reasonable control.
Our total aggregate liability for any claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to TrackBounty in the 12 months preceding the claim, or (b) one hundred pounds sterling (£100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or become inactive for an extended period.
Upon termination:
- Your access to the Service will cease immediately.
- Any approved and confirmed payments owed to you for completed work will still be processed.
- We may retain your data as required by law or as described in our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and close your account.
11. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes informally by contacting us at the email below. If a dispute is not resolved within 30 days, either party may pursue formal legal remedies.
